Mitigation by Written Statement

Napavine Municipal Court allows you to submit a written statement for a traffic infraction or parking ticket instead of appearing at a hearing. If you wish to submit a written statement, please use this form. If you are currently scheduled for a mitigation hearing, this form must be received by the court no later than seven (7) business days prior to the scheduled date of the hearing. You also must provide the court with a valid e-mail address so that the court can advise you about the result of the hearing. No appeal may be taken from the result.

If you are requesting a deferred finding, make sure to check the box on the form below. A deferred finding is available only for traffic infractions. Within a seven-year period, a person may receive one deferred finding. A deferred finding is discretionary, and the Judge may not grant deferred findings on some infractions. Drivers with a CDL or who committed infractions in a commercial vehicle are ineligible. If the judge grants your deferred finding, the decision on your case will be deferred for 12 months. During that time, you must commit no crimes or infractions and pay the fine amount in full.  If you satisfy both conditions, your infraction(s) will be dismissed. If not, the infraction(s) will be found committed. The finding will be reported to the Washington Department of Licensing (DOL), who may begin processing your driver’s license for suspension.
